1. Acceptance of Terms
By accessing or using Varsity Learning (varsitylearning.com), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the platform. These terms apply to all users including students, instructors, and administrators.
2. Description of Service
Varsity Learning provides a web-based math learning management system that includes online homework, course templates, integrated gradebooks, student analytics, and instructional content for high school mathematics courses. The platform is operated by Varsity Learning, Inc., a Delaware corporation.
3. User Accounts
Instructor Accounts: Available upon request. Instructors must provide accurate institutional information when requesting an account. Accounts are subject to verification.
Student Accounts: Students register using enrollment keys provided by their instructors. A per-semester access fee may apply. Students under 13 must have parental or school consent.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Acceptable Use
You agree not to:
- Share your login credentials with others
- Attempt to access another user's account
- Use automated tools to scrape content or submit assignments
- Upload malicious content, viruses, or harmful code
- Use the platform for any unlawful purpose
- Reproduce or distribute course content without authorization
- Interfere with the platform's operation or other users' experience
5. Intellectual Property
All course content, question libraries, software, and materials on Varsity Learning are the property of Varsity Learning, Inc. or its licensors. Instructors retain ownership of original content they create on the platform. Students retain ownership of their submitted work.
6. Payment Terms
Student course access fees are non-refundable after 14 days of purchase or after substantive use of course materials, whichever comes first. Institutional site licenses are governed by separate agreements. Payment processing is handled by Stripe; Varsity Learning does not store credit card numbers.
7. Service Availability
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for data loss resulting from user error, unauthorized access to your account, or circumstances beyond our control.
8. Account Termination
We may suspend or terminate accounts that violate these terms. Instructors may request account deletion by contacting support. Student data is retained per our Data Collection Practices and FERPA obligations.
9. Limitation of Liability
Varsity Learning is provided "as is" without warranties of any kind. Varsity Learning, Inc. shall not be liable for indirect, incidental, or consequential damages arising from use of the platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Changes to Terms
We may update these terms at any time. Material changes will be communicated via the platform or email. Continued use after changes constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Luis Obispo County, California.
